could break more roars. 105 in livermore. coming up, we will lock at the slow cool down coming up. a 6-year-old girl is recovering after being hit by stray bulls that hit her in the arm and ended up lodged in her pillow. it happened around 2:15 this morning and the girl is expected to survive and police have not made any arrests yet. >> the red cross is taking care of nine people after a fire in bay point. flames broke out around 11:30 and jumped from the house to cars that were parked on the street. three people were sent to the hospital. firefighters are still looking into what started that fire. >> gubernatorial candidates meg whitman and jerry brown will square off and the hour-long debate starts on the uc davis

campus. polls show a close race and a lot of people say the debate could be crucial. >> 6:01 and a short delay in the execution of a death row inmate. the governor pushes back albert greenwood brown's date with death to wednesday at 12:01 a.m. today in the bay's christie smith has what's behind the reprieve. good morning. >> good morning to you. the new information is that albert greenwood brown is scheduled to die by lethal injection thursday night at 9:00 p.m. the governor issued a statement saying a reprieve was necessary because the injunction won't expire until thursday. the earlier date was wednesday at 12:01. as a result brown has more time for appeals and a clemency request. in addition, the state is running out of time because one

of the drugs needed to carry out the execution is about to expire. the department said brown's execution may be the last until they can get a new supply of the anesthetic that only has one dose left. >> apparently they created a situation where they have a three-hour window to carry out the execution before their drugs expire and they may no longer legally use them. >> the 56-year-old brown was convicted of raping and killing a 15-year-old girl in riverside in 1980. if brown's execution is delayed past friday, the state may have to wait until next year when the drug manufacturer said more of the drug will become available. of course today more legal action is expected with appeals in both state and federal court. reporting live at san quentin, christie smith, today in the bay. >> a correction on that. it's not wednesday at 12:01, but thursday at 9:00 p.m., correct?

>> that's exact low right. >> thank you very much. two american soldiers have been killed in iraq and one from stock. scott is following the developing stories on this and it looks like like they may have died in a shocking way. >> it's sad, but in this case particularly sad. the pentagon said it was murder at the hands of an american serviceman. the specialist was 20 and another man from connecticut was shot and killed. we are seeing video there of the soldier who was kill friday stockton. the family who lived in sacramento was ychled of their son's death that he died in iraq but it wasn't until later they heard through the news it was at the hands of another soldier. that soldier also a specialist is in a military jail in baghdad. . >> thanks a lot, scott. congresswoman jackie spears is

will propose a bill to strengthen pipeline regulations across the country. under the bill, home owners would have to be notified if they live within 2,000 feet of a gas line. spears is also pushing to have all natural gas lines equipped with an automatic shut off valve. after the disaster in san bruno, it took two hours to manually turn off the gas and firefighters say if the process had been automatic it would have been quicker and there would have been a lot less damage. a new survey finds a massive oil spill in the gulf affected coastal residence financially and emotionally. 26,000 residents and found cases of depression were up 25% since the oil rig explosion in april. a well being index found many are stressed out, worried and sad. it may get worse as finances continue to struggle in the fall. a trial date is set for the

people charminged with holding and torturing a boy in a tracy home. defense lawyers wanted jury selection pushed back, but a judge said it will begin as planned on october 12th. michael schumacher and his wife face changes of aggravated mayhem, torture and false imprisonment. a boy escaped in december of 2008. the couple's neighbor and the teen's one-time guardian were also charged in the case. police officers are making a push to get stun guns after a deadly shooting. saturday officers shot and killed a man and now officers say the shooting could have been avoided if they were armed with tazers. the commission shot down the plan to get the tazers to officers originally. they objected to the cost. san francisco mayor newsom thinks the city should take a look at how other cities use the tazers. a big honor for peace officers.

jerry brown and governor schwarzenegger will present them with the medal of valor. captains are among the honorees. >> turns out the best s.w.a.t. team in the west is from the north bay. sonoma county special weapons and tactics unit won the best of the west award this year. this is video of the competition from a couple of years ago hosted by the santa clara county sheriff's office. deputies dealing with hostage situations and they compete in shooting contest and sonoma beats out 25 other teams from across the state. >> california is one of 30 states to ban texting and driving to prevent accidents. the ban could be causing more problems than they prevent. bob redell shows us why. >> very funny.

california enacted the law to make the road safer, but if you believe the research from the highway lost data institute, it's possible that this ban is having the opposite effect. what they did is compared insurance claims in four states. california and three others before and after the ban. it found that in three states, the number of crashes actually increased slightly. california there was a 12% bump among drivers 25 years old and younger. why? here's the theory. before the ban we were able to drive like this. one hand on the wheel and texting. your eyes would be level with the road. now the ban is in effect, people are still texting, but trying to avoid police so they keep the phone down here and you can imagine your eyes are nowhere near the road, not as near as before. they are doing this thing and there is a better chance of getting in an accident. that's the theory. it's not proven and they did

test it out in and they think it might be happening. the institute which is funded by insurance companies will be releasing the study at the governor's highway safety association. it's not expected to receive a warm reception from the state to have enacted the ban. the institute is not challenging the notion that texting and drive suggest not safe. it argues that enforcement sneads to be stepped up. the secretary of transportation calls the study misleading and noting that deaths caused by distracted driving have stopped increasing in states that enacted such a ban. one advocate of safe driving points out it did take years for people to notice the effects of seatbelt laws. bob redell, today in the bay. >> check your phone. look what i sent you. i told him to wrap. time's up. >> at least he is not driving right now.

another check in with mike. >> sometimes you worry about me walking and chewing gum. watch the texting as well. off of southbound 880 and folks off the nimitz freey and towards city streets. might encounter standing water, but chp sent crews to check it out. the water might be due to the construction zone. they didn't find pipe that needed repair. if there problems it will be a big issue heading over the water at the bridge as well. livermore continues to show that westbound. 17-minute drive registering speeds towards 50. below you see the yellow. on average, you are about 50 miles per hour over towards the dublin interchange and walnut creek looking nice. no problems there and we have eastbound 80 opposite the main commute. the car went into a pole. no major injuries, but wires are down. we have wires hanging over the roadway as well.

a live look in oakland. you can't see how warm it is. thankfully we will see a cool down coming our way quickly. temperatures are in the 60s and 70s this morning. it's 66 degrees in oakland right now. 70 in san mateo. 73 in san francisco and 67 degrees in concord. we were hoping to cool things down, but the weather models kept the temperatures way up. a little bit of a sea breeze will make it onshore, but for most of us it is going to keep things hot today. air quality is not great at all. that's a look at the forecast highs. 102 in concord and yesterday we saw temperatures all across the region. >> we felt it. thanks so much. new this morning, firefighters are looking into the cause of a fire in bay point. nine people were in this house

on madison street near highway four. three are injured. the fire started around 11:30. the flame jumped to several cars parked outside. a man told today in the bay the house belongs to his grandmother and he got there before firefighters did. >> i'm pretty sure that's what hell looks like. it's heart stopping to see the way the flame came out the front door to the window. >> the red cross is taking care of the people who lived in the house. >>. >> temperature are blistering hot in southern california as they are here and they sparked a wildfire down there. firefighters hoping to get the upper hand on a fire burning in ventura county near thousand oaks. about 50 acres have burned, but they made progress and the fire is more than 50% contained. no buildings have burn and no reports of injuries either. we have amazing video with moments of a massive mudslide.

it gives way. more than a dozen people were on the road in columbia when the mudslide fell down on it. you can see the cliff give way, crashing on homes as well as a group of people changing buses after another mudslide blocked the road and they were trying to get out. they will try to get to the victims after heavy rain delayed the efforts yesterday. >> president obama returns to the campaign trail selling his policies and party's goals during stops in four states. he will speak during visits in new mexico today. he is set to hold events in iowa and virginia. we could learn as early as this week if the presidentville to find a new chief of staff. the sources say he will announce as soon as friday if he is leaving his position it run for mayor of chicago. an lives expected he would pursue the position when the mayor announced he wouldn't run for reelection.

many say he will wait until mid-term elections are over to put in the bid. he has until november 22nd to file the paperwork. >> proof that the smartest people live here in the bay area. two professors and oakland writer and a stanford geneticist are among the winners at this year's foundation genius grants. each winner gets $500,000. it includes berkeley economists and computer security specialist and chinese born fiction writer yee union lee and stanford genetics professor carlos bustamante. >> cal state campuses will be more crowded next year as they plan to admit up to 30,000 new students for the winder and spring term. they closed admissions last year because of budget cuts. they began mailing out acceptance letters yesterday. state lawmakers and the

governors are committed to restoring $366 million in funding to the csu system. preventing school dropouts is a folkinous washington. state general colin powell will talk about the two-year prevention effort. 1.3 million american students dropout of school each year. the government identified 2,000 low performing schools that produced nearly half of the nation's dropouts. president obama wants to shut the schools down or turn them into charter schools. educators are honing in on the ninth great-based research. >> ninth grade has proven to be the most critical to determine high school graduation. >> jobs require a college education. >> the alliance for excellent education said keeping kids in school can help the bottom line, saving billions of health care, crime, and preparing the next

environment and claim 240 target stores across the state violated rules in disposing of hazardous waste, using unregistered haulers and disposing of things like batteries, telephones and computer and electronic equipment. >> san francisco is trying to do more to entice the film industry. the city wants to partner with businesses and offer discounts to filmmakers that bring productions to the city by the bay. it's one of the ideas being worked out by the director of the film, commission. the hope is by offering hotels and discounts, production companies want to move the shoots here. . welcome back. we will have an update on an accident reported a while ago. southbound 101. coming out around the brake check area, they are heading southbound. the back up is slow with folks

what were the facts? fact: march 7, 2000. brown asks voters for new mayoral power to appoint school board members. he gets it, and promises better schools. but the drop out rate increases...50%. the school budget goes into a 100 million dollar deficit. the schools become so bad...the state has to take them over. it was "largely a bust," he admitted. jerry brown. failure as governor. failure as mayor. failure we can't afford now.

one of the bay area's most spirited groups is helping athletes across the world. cheer sf was on top on "america's got talent" this season. the group is giving dignitaries from the gay games an $8,000 check to help gay athletes from third world countries competeful the group has raised over $200,000 to help support those affected by hiv, aids, breast cancer and other conditions. the san francisco giants are back home and back in action. the magic number is six. any combination of wins by the giants and losses by the padres that adds up to six puts the giants in the playoffs. they lead the national league west by game over san diego. tonight is the start of a-game series with the diamondbacks and what could be the big showdown. the padres coming to town on friday. meantime, 49ers trying to piece

execution and compare the old procedures to the new procedures that would be used here at san quentin. it's unclear if the review would happen by thursday night when ath bert green brown is scheduled to die by lethal injection for raping and killing a 15-year-old girl in riverside in 1980. the district court had denied a stay of execution the original time at 12 tile time 01 a.m. wednesday. the governor issued a statement saying a reprieve was necessary because an injunction wouldn't even expire until thursday. in short, this is not over quite yet. >> they were forced to delay the execution until thursday to allow albert brown enough time to appeal in his case. >> the appeals court said it appeared the execution date was chose nen part because the state supply of one of the lethal drugs expires on friday.

if brown's execution is delayed past that, the state may have to wait to execute him because the drug's manufacturer said new supplies may not even be available until january. live in san quentin, christie smith, today in the bay. >> thanks for the update there. >> lawyer a lot of questions surrounding this death sentence. when he was told he was going to die, albert green brown was given the option of one injection or a series of three. is there a difference? a law professor at santa clara university joins us to talk about that and this case as it unfoals as we speak. thank you very much for joining us. >> good morning. >> it was interesting that he was given a choice. does that normally happen? >> not only it normally happens, but it's more than interesting. that was not really a legal choice. california law and procedures that were issued by the attorney

general's office were provided for a three-drug procedure and there is no one-drug procedure in california. the fact that the judge gave him a choice of one drug was really something that got pulled out and the state started scrambling to figure out how they could implement that. >> the state has been having problems deciding all of this in the first place. michael morales is the reason that it has been years since someone was put to death. he was supposed to be execute and his appeals are still being heard. why did the state jump in to put brown now to death so quickly? >> that's a question many are asking. even the judge asked that question. everyone expected the judge that the state would come in and ask for a date for mr. morales and if they did, they had to go to the judge and request it. we can only wonder why they chose not to go with mr. morales and went to riverside county and

set an execution date on mr. brown. politics may be playing a part. no one knows what the motivation was. >> do you think can use the same arguments to appeal? >> brown did use the same arguments as morales, but what happened when it went before a judge although he indicated in the morales case, he would have examined it more carefully and looked at the regulations in his opinion on friday. i just don't have enough time to review the regulations before brown's execution date. the judge was willing to let the execution go forward without reviewing the regulations. >> it's interesting. it's pushed back to thursday at 9:00 p.m. now you have the drug manufacturer involve and the lethal cocktail is going to expire on friday. do you think it's going to be carried through? what are the chances? >> the ninth circuit issued an order and said what i think has been on the minds of many of us. why is this procedure being

driven by an expiration date on the drugs. new drugs will be available after the turn of the year and the case was support back saying you need to take a look and compare them to the old procedures that you found unconstitutional and do it without being worried about an expiration date. that's not the careful review we should have in an action of this magnitude. the state is trying to kill someone. the least the court should do is make sure it's done in a constitutional way. >> that's interesting and we are coming under the wire here. thank you for joining us. >> thank you. >> we want to get the latest on your morning commute. there back ups out there. >> first of all the bay bridge toll plaza and the metering lights are turned on. we are going back to west grand wave slowing approaching with 20 minutes approaching the berkeley

another hot day andwe will only see some cooling along the area beaches and we have more bad air quality. warm this morning and 70 in san mateo. 65 degrees this morning in livermore and 67 in concord. bad area quality in the red in southern valleys as well. here are the forecast highs. 105 in livermore and 103 in morgan hill. 89 in the city. yesterday we broke seven roars it was so hot. we might break more roars again, but thankfully it will start to cool down tomorrow. >> are thanks a lot, jennifer, a promotion for the youngest son of north korea's kim jung il. he made the 28-year-old a-star general. his first official title in confirmation that he is slated to be the next leader.

you can see a number of officers as well as work crews here putting up signs since this is going to be televised throughout california. the uc davis campus wants everyone to know where it's happening, but security is going to be extremely tight here. dozens of officers will be here including a bomb-sniffing dog to make sure that everyone a tens, especially the candidates are safe. there a number of protesters that are setting up shop here on campus. they arrived here at 6:00 this morning. there will be a number of 10s and labor groups will be here. it is expected to be quite the show between brown and whitman here. polls find they are neck and neck right now. there is much anticipation on how the candidates will do during the hour long debate. brown has decades of experience debating and some say whitman does not. we will see how it goes. about 1,000 sicks were issued for the event and they're

states ban particularing and driving in order to prevent accidents. it turns out the bans could actually cause more problems than they prevent. bob redell is live to explain why. bob? >> when california enacted the ban on texting while driving over a year and a half ago, it was supposed to make roads safer. if you believe a study from the institute, it is actually having the opposite effect. the institute compared insurance claims in california and 300 states before and after the bans. it found that in states, the number of crashes actual low increased slightly. california there was a 12% bump in crashes with drivers 25 years old and younger. the theory is that people are ignoring their bans and they are texting while driving. instead of texting up here like you used to when it was legal, they are texting down here to avoid police. they are texting in their lap and obviously their eyes are

further away from the road. there is the increase in the accidents you are seeing because people are not able to react as quickly. the institute which is funded by insurance companies is releasing this information and the study today at the governor's highway. it is not expected to go over well because a lot of states that will be there have enacted the ban on texting and driving. here it is being challenged. the institute does not argue that texting while driving is safe. it's not making the argument, but trying to point out that maybe enforcement needs to be stepped up. the secretary of transportation is calling the study completely misleading, noting that deaths caused by distracted driving have stopped increasing ever since the ban started to go into effect. live here in san jose, today in the bay. >> thanks a lot, bob. it is a problem. >> it is. a lot of distractions out there. remember when you used to just

drive in the car? how many people are out there doing it right now? >> focusing on the roadways and the wires. these are not phone wear e wires. they are taken down after a minor injury accident, but the west nile virus were hanging over the roadway. they very cleared off to the side and no major slowing opposite the commute direction. you have the typical slowing out of hercules and san pablo and clearing by the time you get to the bridge and the golden gate field. things change with the toll plaza. a live look shows you you fill in all the lanes and barely any movement towards the 880 overcrossing. typical for that portion of your east bay commute and lighter than we see on a tuesday. maybe some folks are sparing the air and we have been asking for that. southbound 680 sorted itself out and it stops around this place where you join in. that's great news.

execution is set for thursday night at 9:00 p.m. instead of wednesday at 12:01. a couple of things happened. late last night they asked a judge to reconsider a stay and also to compare the state's old procedures with the new procedures. it's unclear whether that will happen in time when albert greenwood brown is skulled to die. the governor issued a statement saying an injunction against executions won't expire until thursday. to further complicate marries, the state supply of one of the lethal drugs expires friday. we created a situation where they have a three-hour situation that they can carry out the execution before the drugs expire and they may no longer use them. >> brown was convicted of raping and killing a 15-year-old
